1. Agreement

These Terms of Service ("Terms") govern your use of TestPlan, operated by The Code Guy Ltd ("we", "us", "our"). By creating an account or using TestPlan, you agree to these Terms.

If you're using TestPlan on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

TestPlan is a test management platform that allows you to organize features, create test cases, execute test runs, and track releases. We provide the service on a subscription basis.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We'll notify you of significant changes via email.

3. Your Account

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

You must provide accurate information when creating your account and keep it up to date.

4. Acceptable Use

You agree not to:

• Use TestPlan for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious code or content
• Resell or redistribute the service without permission
• Use the service to send spam or unsolicited communications
• Violate the rights of others

We may suspend or terminate accounts that violate these terms.

5. Your Content

You retain ownership of all content you create in TestPlan (features, test cases, documentation, etc.). By using the service, you grant us a limited license to store, process, and display your content solely to provide the service to you.

You are responsible for ensuring you have the right to upload any content and that it doesn't violate any laws or third-party rights.

6. Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Prices are listed on our pricing page and may change with 30 days' notice.

• Payments are processed securely through Stripe
• Failed payments may result in service suspension
• We offer a 14-day money-back guarantee for new subscriptions
• Refunds outside this period are at our discretion

7. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You can export your data before the subscription ends
• After the subscription ends, your data will be retained for 30 days before deletion

8. Intellectual Property

TestPlan, including its design, features, and documentation, is owned by The Code Guy Ltd and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the service.

9. Disclaimer

TestPlan is provided "as is" without warranties of any kind, whether express or implied. We don't guarantee that the service will be uninterrupted, error-free, or meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, The Code Guy Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless The Code Guy Ltd from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
